This privacy policy explains in plain English what personal information emailmarketingagency.com collects, what we do with it and how to have it corrected or deleted. Momo Digitals, the company behind EmailMarketingAgency.com, runs the site from its mailing address at 131 Continental Dr, Suite 305, Newark, DE 19713, and answers privacy questions at info@emailmarketingagency.com.
Who does this privacy policy cover?
Visitors to this site and anyone who requests a free audit or writes to us. Our clients' subscribers get their own section below, because the business that owns a list decides how it is used.
What personal information do we collect?
| Information | How we get it | Why we use it | How long we keep it |
|---|---|---|---|
| Name and work email (required) | Our free audit request form, or your email to us | To reply and send your audit | While we are in touch, or until you ask for deletion |
| Website, email platform, list size range and your message (optional) | The audit form | To review your setup before we reply | Same as above |
| IP address and submission time in UTC | Added by our form handler to the email we receive | To spot spam and abuse | Stays with that email |
| Request data: IP address, browser, page and time | Our web host's standard server logs | To keep the site online and block attacks | The host's normal log period |
| IP address and browser details | Sent by your browser to Google when it loads our fonts | To display the site's typefaces | Set by Google's own policy |
We never ask for payment details, ID numbers or your subscriber list through this site.
How does the audit form handle your details?
- You fill in the form. Only name and email are required.
- The page loads over HTTPS, so your answers are encrypted on their way to our server.
- A short script turns your answers into a plain text email to info@emailmarketingagency.com. No copy is saved in a website database.
- A hidden field, invisible to people, catches spam bots.
- We reply from that same inbox.
Do we sell or share your personal information?
No. We do not sell, rent or trade personal information, and we do not share it for targeted advertising, which California law calls cross context behavioral advertising. Requesting an audit does not put you on a newsletter or marketing list. Your details reach only our web host and email provider, which act on our behalf, Google when your browser loads our fonts, and any authority that can legally compel disclosure.
Does this site use cookies, analytics or tracking?
- Cookies: our pages set none, so there is no cookie banner.
- Analytics and tracking: no analytics, heatmaps, ad pixels or session recordings. If that ever changes, this page changes first.
- Google Fonts: our pages, and the sample emails on our campaign examples page, load typefaces from fonts.googleapis.com and fonts.gstatic.com. To send those files, Google receives your IP address and browser details, which it handles under the Google Privacy Policy.
- Links to other sites: our guides cite outside sources such as the FTC and Google. Those sites follow their own privacy policies, not this one.
How do we respond to Do Not Track and Global Privacy Control?
California's Online Privacy Protection Act (CalOPPA, Business and Professions Code section 22575) requires a privacy policy to say how a site responds to Do Not Track signals when it tracks visitors across other websites. We do no such tracking, so the site works the same with the signal on or off. The California Attorney General says covered businesses must treat a Global Privacy Control signal as an opt out of sale or sharing, and we do neither for anyone.
How do we handle client subscriber data?
When a business hires us, we work inside the email platform it already pays for, such as Klaviyo, Mailchimp or HubSpot (see every email platform we work in). The client owns that account, its list and its templates. We use subscriber data only for that client's campaigns and reports, and never email those people for ourselves. A subscriber with a privacy request should contact the business that sent the email, since it controls the list.
Every campaign carries a clear way to opt out and the sender's postal address, as the FTC's CAN-SPAM guide requires, and the FTC gives senders 10 business days to honor an opt out (our CAN-SPAM compliance checklist covers each rule). Subscribers can stop emails with the unsubscribe link in any message.
What privacy rights do you have, and how do you make a request?
According to the California Attorney General, the CCPA gives California residents the right to know, delete and correct personal information, to opt out of its sale or sharing, to limit the use of sensitive personal information, and to equal treatment after using those rights. The Delaware Code shows that Delaware's Personal Data Privacy Act grants similar rights, including a copy of your data in a portable format. Each law only covers businesses that pass its own revenue or data volume thresholds, but we honor the same requests from anyone in any state.
- Email info@emailmarketingagency.com with "Privacy request" in the subject line.
- Tell us what you want: a copy of your data, a correction or deletion.
- Write from the address you used with us, so we can confirm it is you without asking for ID.
- We confirm what we did within 45 days, the response deadline in Delaware's law.
How do we keep your information secure?
No inbox is perfectly secure, so never send passwords, card numbers or platform logins to us. If you hire us for our monthly email marketing package, you invite us as a user inside your own email platform, so you can remove our access anytime.
Is this site meant for children?
No. It is for businesses and is not directed to children under 13. In line with the FTC's COPPA Rule, we do not knowingly collect their information and delete any we find.
How will you know if this privacy policy changes?
This policy is effective from the last updated date at the top of this page. If we change how we handle data, we will update the page and that date. Questions can go to info@emailmarketingagency.com or by post to the Newark address above. Rules for using the site itself are in our website terms of use.
Frequently asked questions
Will requesting a free audit add me to your mailing list?
No. We write back about your audit and nothing else, and we never subscribe you to a newsletter or promotional list. If you ask us to stop emailing you, we stop.
Does EmailMarketingAgency.com use Google Analytics or tracking cookies?
No. There is no Google Analytics, no ad pixel and no cookie set by our pages. The one outside request your browser makes is to Google Fonts for the typefaces.
How do I get my information deleted?
Email info@emailmarketingagency.com from the address you used with us and ask for deletion. We remove your audit request and messages and confirm by email, within 45 days at the latest.
