These terms of use apply whenever you visit EmailMarketingAgency.com, read our guides, run our revenue calculator or send us a free audit request. Using the site means you accept them, so if you do not agree, please do not use it.

Who do these terms of use apply to?

On this page, "we" and "us" mean Momo Digitals, the company behind EmailMarketingAgency.com. "You" means anyone who visits, plus any business you represent. The site is meant for adults acting for a business, and if you use it for a company, you confirm you can accept these terms for it.

Are these terms a client contract?

No. Browsing, running the calculator or requesting an audit does not make you a client and never obliges you to pay. Our flat $1,000 a month email marketing package for 8 campaigns starts only once we both agree to written service terms. If those service terms and this page ever conflict, the service terms control the work we do for you.

What can you do with our content?

Unless a page says otherwise, the writing, guides, layouts, graphics, calculator and code on this site belong to Momo Digitals or are used under license. You may:

  • Read, print or save pages for your own business use.
  • Share links to any page, including our email marketing guides.
  • Quote short passages with credit to EmailMarketingAgency.com and a link to the original page.

You may not:

  • Republish a full guide, or large sections of one, anywhere.
  • Copy our page designs, calculator or content in bulk into another site.
  • Use our name in a way that suggests we endorse you or what you sell.

Who owns the brands and images in our portfolio?

Our email campaign examples are real campaigns we designed and wrote for businesses such as Prifix, Whapi, ExpenseTracker, HomeStop and several US RV parks. The names, logos, product photos and other images in those emails belong to their respective owners. We show them only to illustrate our design and copywriting, and showing them does not mean any of those businesses endorses us.

Prices and discounts in the samples, such as the LE 11,500 price on the Prifix G70 Gas Cooker or up to 25% off consoles in the HomeStop Console Edit, belonged to the original send. They are not live offers, so please do not rely on them.

What to include in a copyright notice

A copyright complaint is easiest to act on when it has the details that section 512(c)(3) of the US Copyright Act lists for a takedown notice:

  1. Your physical or electronic signature as the owner or its authorized agent.
  2. The copyrighted work you believe is infringed.
  3. The material you believe infringes it, plus the page address so we can find it.
  4. Your name, mailing address and email address.
  5. A good faith statement that the use is not authorized by the owner, its agent or the law.
  6. A statement that your notice is accurate and, under penalty of perjury, that you may act for the owner.

Sending us an audit request or message

When you use the form on our free email audit page or email us, give accurate details and share only information you have the right to share. Never send passwords or platform logins. Our privacy policy explains how we handle what you send.

Are our guides and calculator advice?

No. Our guides give general information about email marketing, not legal, tax or financial advice. The CAN-SPAM compliance checklist, for example, summarizes federal rules, but only a lawyer can advise on your own situation. The email revenue calculator multiplies the numbers you enter, so its output is an estimate, not a promise. We do not guarantee results from any email, guide or tool.

What uses of the site are not allowed?

  • Anything unlawful, including spam sent through our form.
  • Attempts to break, overload or gain unauthorized access to the site or its server.
  • Malware, or forms sent under a false identity.
  • Scrapers or bots that slow the site for other visitors.

We may block or limit access, without notice, for anyone who breaks these rules.

We link to outside sources such as the FTC, Google, Klaviyo and Mailchimp, but we do not control those sites or answer for their content and privacy practices. Platform names on this site are trademarks of their owners.

No warranties

We work to keep every page accurate, but laws and platform features change. To the fullest extent the law allows, the site and everything on it are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and noninfringement.

Limitation of liability and indemnity

To the fullest extent the law allows, Momo Digitals is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of this website. Our total liability for any claim about the website is limited to $100. Some states do not allow certain limits, so parts of this may not apply to you.

You agree to cover our reasonable costs from claims caused by your misuse of the site or your breach of these terms.

Which law governs these terms?

The laws of the State of Delaware govern these terms, without regard to its conflict of law rules. Before filing any claim, email us a description of the problem and give us 30 days to try to fix it. If we cannot, any dispute about the website will be heard only in the state or federal courts located in Delaware, and both sides consent to those courts.

Changes to these terms of use

We may update this page as the site changes. The "Last updated" date shows the current version, and using the site after an update means you accept it. If a court finds any part of these terms unenforceable, the rest still applies.

How can you contact us about these terms?

Email info@emailmarketingagency.com. It is our only contact channel, so both sides keep a written record. Letters can go to Momo Digitals at the mailing address 131 Continental Dr, Suite 305, Newark, DE 19713.

Frequently asked questions

Does requesting a free audit make me a client?

No. An audit request, a calculator run or a visit to any page creates no client relationship and no bill. You become a client only after agreeing to written service terms with us, which is also when the $1,000 monthly plan starts.

Can I quote your email marketing guides on my own site?

Yes. A short excerpt with credit to EmailMarketingAgency.com and a link back to the page is fine. For anything longer, such as a full checklist or a whole section, write to info@emailmarketingagency.com and ask first.

What law governs the EmailMarketingAgency.com terms of use?

Delaware law. Momo Digitals runs the site from a Newark, Delaware mailing address, and a website dispute that cannot be settled by email within 30 days goes to a state or federal court in Delaware.
